Hi all, I was hoping that I could get some guidance as to how I should proceed with this. Thank you in advance. The accident occurred 7 days ago in CA. I was driving home from work in the 4th lane of a 4 lane highway. There was a gap of approximately 4~5 cars in the 3rd lane, so I switched into that lane. By the time I finished the lane change, there was approximately 3~4 cars distance between me and the car behind me. I then drove for approximately a 100 yards, at which point the traffic suddenly slowed and I decelerated. The guy behind me, however, seems to have been looking elsewhere and rear ended me. However, before he collided, he managed to swerve his car and hit the corner of my rear bumper with the corner of his front bumper. We pulled over to the side of the road and exchanged information. It turns out that he does not have a driver's license (or any California/U.S. ID; he showed me a Mexican ID). He begged me not to call the police, admitted fault and said that he would settle it through his insurance (he is insured with a VERY shady place called Access General). I took pity on him, especially since it was very likely that he is an illegal immigrant, so I just took his information down and moved along. Fast forward a few days, and I find out that he has told his insurance that I cut in front of him and that he is not at fault. Since there are no witnesses or a police report, his insurance takes his side. Meanwhile, since I only have liability with Geico, they are saying that they can't help me. The damage to my car is between $4~5k, and that is not even taking into account devaluation of the car's value. I feel very cheated because I took pity on him and I am rewarded with a repair bill that nobody wants to deal with. I have called him multiple times and asked him to tell the truth, but he just ignores me. I am now very angry and want to do 2 things: 1. Get my car repaired. 2. Screw up his life. Hopefully get him deported (very strong liklihood of him being an illegal immigrant), or at the least bankrupt him. I took pity on him because he was in a time of need. All he had to do was tell the truth to his insurance, but he was afraid that his monthly bill would go up... so he lies and screws me instead. Do you have any recommendations for lawyers who would be willing to take on property damage lawsuits? What are my options?

Maybe this is a stupid question, but I'm new to this. So my fiance and I bought our first home pretty recently. Yes, I'm a bad person and did not read through or understand everything in the giant insurance book. I'm a bit confused as to how homeowner's insurance would cover belongings in the event of a theft, accident or whatever. We chose a low, $500 deductible. Let's say there was a theft. And I estimate the belongings stolen were worth $2000. What's stopping me from saying they were worth $3000? Or more? Wouldn't they want some kind of proof as to the value? Confused about this i went to Sec of State and in fact found out that i have no points. I called Memic and explained this to them, they informed me that they do not use actual points, they use their system of points. For example OUID is a 6 point offense but they count it as 8 points. Passing a stopped school bus (which as far as i can tell is no points) they view as 8 points. My question is, can they do this? I worked with one local agent, dropped my car off at the Progressive repair center where they had my rental waiting for me, and returned the rental there when I came to pick my car up. Plus I never have to wait long to talk to someone when I call. However, I'm newly married and have found we would save a considerable amount by moving my two cars to my husbands policy with State Farm as opposed to moving his car to my policy with Progressive. Please let me know what type of experiences you've had with State Farm and if you would consider their service as excellent as I have with Progressive. Even if State Farm is cheaper, it won't be worth the savings if their service is crummy. Thanks!

Before you answer, please read this thoroughly. I am a student and Illinois Resident. I have PPO health insurance in Illinois that I pay out of pocket for. $1000 deductible, 100% covered. I go to school in Florida and have employer insurance in FL (ever since Sept 2008), but it's an HMO. The PPO my job offers has no deductible but is 80/20 coverage, so I opted the HMO. For the average person, it would make no sense to have 2 policies, but I'm not ordinary. I have many pre-existing conditions (some I was born with), hence the Illinois coverage. In Dec of last year, before my FL insurance kicked in, I had a multitude of issues which caused me to have to use my BCBS of IL in Florida where I'm attending school. Many of those things are at bay now, but for doctor visits, exams, etc to arise other than routine check ups, should I start using my FL HMO insurance and just use my IL insurance for when I visit home during breaks? Or should I just drop my FL insurance altogether? The reason this is an issue is b/c I am afraid I my rates will go up or they drop me if I continue to use my insurance which was meant to be for IL, but I have been using it in another state. Yes they will cover b/c it's PPO and it falls under the BCBS umbrella, but this is the risk I take. I will NOT drop my Illinois insurance because I have pre-existing issues that is NOT covered by my FL insurance, so switching isn't even on option. Plus they keep doing layoffs and my certainty at this job isn't guaranteed. Furthermore, I keep reading about fraud, this is not my intent. At age 36 in a blue-collar job (i.e. chance of disability over 90 days less than 10%), I'm thinking it may make more sense to get long-term care insurance rather than long-term disability. I bring in 30% of our household income. If I become disabled, I count for very little of our total spend (obviously food, but I wouldn't be doing much in the way of leisure / entertainment), but the added costs of caring for me would be too much for our budget to bear. I also think it would be very hard to qualify for disability for class 1 (a desk job sitting in front of a computer all day). It seems like it would be easier to qualify for two functions of daily living. I know they technically cover two different scenarios, but isn't there a lot of overlap here in terms of when you would actually get a pay out? Just trying to understand. I have just returned from 2 months being away and was very much surprised to read letters from tesco insurance about being unable to take money from my account for the annual renewal of my policy and therefore cancelling it. I talked to my bank and they said that there were not attempts to take money from my account by tesco. While tesco says that my card has been refused. I asked tesco if they could reinstate my policy due to some fault with the payment, which does not seem to be my bank they say that cancelled policy cannot be reinstated and suggest to pay 230 for the period that they were trying to collect and open a much more expensive new policy. They also told me that I face penalty because my car is uninsured now. I would like to reinstate the policy as cancelled unfairly and at the same time I need to insure my car quickly to avoid facing penalty. I wanted to maintain Tesco policy in case they reinstate it, as i will not have cancelled policy on my records and will not have to pay extra for the month, they have been cancelling my account, i also have 2 years no claim with them, provided another insurance, whose car slightly dammaged my front door, while i was parked at a petrol station, pays them. This insurance admitted that it was their fault, but have not finished paying Tesco. This is another reason, tesco could do me even cheaper insurance, once the responsible party pays in full. I was also surprised when i found out that my car is a group 4 insurance, with it being a little 60bhp 1.2 compared to my mates 130bhp car being a group 5. I cannot go on my mams insurance either as she can only drive an automatic. So I considered selling my Punto and try getting an automatic to go on my mams insurance as she has over 10 year no claims, but her 200 insurance went up to 2500. A little over a year ago, I was in a car wreck and due to financial responsibility laws I had to pay for the accident. (I had no insurance, of course, I've learned this lesson) Recently they've filed suit against me for more money that they didn't receive from the insurance company. I can't afford an attorney and was about to hire a bankruptcy lawyer for all of this, but I recently found out from the insurance company that the case is closed. It's also been over a year as of a couple days ago and due to Tennessee's Statute of Limitations they can't claim any more money. So my question, the insurance company says it's closed and even said the attorney settling with them has closed the case. I call the opposing attorney myself and of course they say they can't discuss the case with me, even though I'm just asking if the case still actually exists. They wont' give me a court date either so naturally, I'm a bit suspicious. Should I be ready to put this behind me, or do law offices do this sort of thing all the time? They were recently paid out $10,000 from the insurance company I'm making payments to. I really don't see where else they could find money given my situation. All answers are appreciated, thank you!

3-car accident, what will insurance do?

I was in a 3 car accident, I was the middle car. It's stop and go traffic at a red light, the line is backed up a good way, and the person in front of me stops. I stop behind them, but the man behind me doesn't stop. He hits me and pushes my car into her car. His car seems to be flawless, the vehicle he knocked me into also seems unharmed, maybe a scratch on the bumper (it was like a jeep or explorer, so my car went up under hers a little) and the front of my car is a little messed up. The police will file an accident report, but while I wait, what can I expect? I'm expecting his insurance to cover the repairs to my car, because this was in no way my responsibility, he hit me into her, I was more or less a ragdoll vehicle. Yes, I hit her, but it's not because I'm a bad driver, I cannot control being hit into another vehicle during a line at a red light. And though it was never mentioned (I was a little shaken, my mind wasn't clear), I am almost certain he was on his phone because he was looking down and doing something when I looked back after he hit me. It's too late to mention that, but yeah. Got the registration and insurance for it 3 hours before I wrecked. Had the car a week.

So the difference between your premiums and the expected benefits you get back is even more. It seems like a very fit, health-conscious person is really taking it on the chin by buying health insurance in the individual market. Why is our group health insurance so much more expensive than getting an individual plan privately?

My husband gets insurance through his work, and they take out $170 a week (he gets paid weekly). So that totals about $730 a month for us and our kids plus maternity benefits. What confuses me is if we were to drop that insurance and get an individual plan with the same company, same deductible, same co-pay, including maternity benefits (exactly the same plan) it would run us about $440 a month. I thought that the whole point of getting on a group plan was that it would be cheaper. I took out an insurance policy with swinton Insurance they quoted me 250.00 I agreed to this amount. I have been driving for over 12 years with no claim made against my policy. Due to the way my previous insurer only counted 5 years no claims bonus insurance that is all they have a record plus three years I was with them. Because the new insurer uses 9 years no claims they now want me to pay an extra 22.00 I know on the one hand this is not a lot of money on the other hand I don't see why I should have to pay it. They are saying If I don't pay it they will cancel it and charge a cancellation charge does anyone know the legal situation whether I have to pay by law or not.

(about 400 per month since im 20). my agent does not want to refund the money for those 3 months, and they do not want to give me a proof of policy. I do have proof of paying them for those 3 months since I payed with a check that they cashed. I want them to give me proof of insurance for those 3 months or to pay 1300 to my loan because they are charging it due to their fault since they forgot to send my payment. Can I do a civil law suit for those 1300. I have proof of my payment for those 3 months. I also have my policy number but it says it's cancelled due to non payment so bank will not accept that as insurance. right after those 3 months I opened a new policy with them and ive had it for 8 months and ive always payed on time. I recently noticed that when they opened the new policy they inputed my date of birth as if i was 40 years old instead of 20. I do not know if they did a mistake or if they did that on purpose to give me a better price. The thing is that all these 8 months I've been paying i was actually never covered since my date of birth was way wrong. Only my name was correct but I talked directly to the insurance and not my agent and they explained to me that if i would have crashed it wouldnt have covered me since they do not have the correct date of birth. I just fixed that directly with the agent and now they have the correct date of birth so the insurance price went up since im only 20. I dont mind about that. I just think it's unfair that i paid for almost a year and that i was actually never covered because they did a mistake on my information. Plus they caused the bank to charge me.. So i just feel like if all this has been a big scam since i paid so much and did not have insurance. Can I sue them to get my money back or at least pay the bank what the bank is charging me for not having insurance.. like i said i have all the recepits of all payments ive done and i also have a copy of the policy where my information is not accurate and how i was paying without being covered. They could not have made a mistake because I do not look like if im 40 years old. besides they obtained a copy of my drivers license where it clearly says my date of birth. So I am 21 years old working part time as a supervisor with a certain big brown shipping company. I am making decent money, and was, at the time, driving a really high mileage 1998 explorer that got terrible MPG and was nickle and dimeing me to death, so I decided to go look for a new car. The car I found, was a 2011 Suzuki Kizashi S. It had really high safety ratings, the car itself was in very good condition (the previous owner was a little old lady who I actually got to meet because her nephew was the car salesman I bought it from, who even brought me all of the paperwork on the maintenance she had - impeccable maintenance record I might add), and the average highway mpg, is double that of my explorer. However, I made a mistake of not confirming what my insurance rate would change to when I called State Farm over the phone to have my coverage changed to the new vehicle, and now here I am paying triple what I did for the explorer. I don't get it, how does a little 4 door sedan w/ awesome safety ratings and all that jazz cost me $224 a month to insure, but a 4WD fully loaded explorer, in Colorado, that I had since I was 17, was only like $63 a month. I mean, I understand that a vehicle that isn't paid off yet is going to have higher insurance thanks to the lender requiring full coverage, but I don't know ANYONE around my age paying this much except for a guy I work with who drives an Acura and got a massive ticket for going a buck 20 in a 45 speed zone and now pays like 350 a month. Is there something particular about this car that I wasn't aware of? It's a great car, but the huge insurance cost is really hurting what I'd planned to be able to afford per month on top of my other bills.

What just because it looks like a sports car it is?? Since 2007 teenagers have been disapointed that they can't get a subaru WRX or STI because of the turbo charger and now that they've made a two door without turbo it's STILL off limits for teens?? I'm 21 a year old university student from California and I am graduating soon. I have always put off getting a license before college and once it started, I have been busy but because I want to get a job after graduating I really need my license pronto! My parents back home already taught me how to drive but I'm signing up for a driving school in my area just to practice and get the local roads down. I made an appointment for behind the wheel test next week and one of the things I need to bring is proof of financial responsibility. Hi, i am a new driver. got my licens in 2011 but due to college i wasnt able to drive around much. after graduation i decided to buy a car and look for insurance. and after reading insurance company reviews ... its kinda scaring the crap out of me. it seems that they are all interested in you buying their service but once you get into an accident you are on your own. i know internet reviews can be bias, so I kinda want to know which auto insurance company would you recommend. here is my basic info: am 23 years old, college graduate, live in a relatively decent neighborhood in southern California, had my license since 2011, and the car am looking into buying is either a new 2013 Toyota corolla or a Nissan sentra. oh and i have never had auto insurance, am not sure if i was covered in my mom's previous insurance but chances are nope. one more thing what kind of coverage would you recommend? and deductible? oh lol and which car would you recommend Nissan sentra or Toyota corolla? and any buying car tips ? thanks you so much for your help, I will defintly be choosing a best answer :)

Knowledgeable Jersey Residents only please! I have recently moved to Jersey, and I am having heart feailure over the cost of car insurance. It is almost DOUBLE the cost in any other state where I have lived. (CT, FL, NY, SC) (I have NO tickets, NO accidents) Also, I was told today that there is yet ANOTHER rule/law in Jersey that states that any family member who lives with you (whether they are under YOUR insurance, or their own insurance) makes you liable in case of an accident. In other words, if my adult daughter (who has a poor driving history) gets in an accident--I COULD BE SUED.....EVEN if she has her own car, and her own insurance. CAN THIS BE TRUE???? It is very important that I get a straight answer, as it will drastically affect my ability and desire to stay as a resident in New Jersey.
