After a solicitors firm managed to draw out a car insurance claim for 18 months I finally settled 50/50 on the incident, instead of refunding me 50% (400) of my excess the solicitors paid me 100% (800). I verbally informed them of the error before they issued the cheque and they still proceeded, now they have noticed the error they are asking for me to return the money. Am I legally obliged to do so and how far are they likely to pursue this if I do not?

Rear Ended - Can I demand insurance?

I was in an accident last month in my brand new Volvo (not even a month old!). I was rear-ended, while I was at a stop sign. I contacted a friend of mine, who is a police officer, and they stated that I can issue a summons to the person who hit me for careless driving, and I will have to go to court. This is basically to show them that I'm not messing around. All I want is my BRAND NEW car fixed!!! I'm NOT going through my insurance because my deductible is $1,000, and the damage is less...not only that...it wasn't my fault! My insurance company advised me to have person who hit me's insurance take care of everything, at no cost to me. Here's what I need to find out...Can I send the person a demand letter, basically stating that I want them to have their insurance take care of everything? I have tried to call them, and they send me to voice mail, so reasoning is not an option any more. I don't really know how to go about this?! I want to try this on my own, and not get an attorney involved. I just want to tell them that if they fix my car, I will drop summons and further proceedings (like small-claims court, which I WILL sue for additional $$ for dealing with all this). But, what if they don't have the money? I have no idea what to do. I live in NJ, hope someone can help!

So here's my story. I want to learn to drive standard before I purchase my serious car but the thing is, I dont know how! Recently my friend had an accident. His car is an import and the insurance company want to write it off and as they cannot get hold of replacement parts. Does he have the right to refuse their offer for pay out as the car is worth more than they are giving him. As its an import, and a sports car, he knows he can get more for it on auto trader and eBay. I'm so frustrated with how our country handles healthcare - it should be a basic right for all citizens, not a big business. Anyway, my boyfriend and I are full-time students currently living off of student loans and not working while we are in a very demanding program. I am closing soon on a small commercial property. It is a smaller restaurant/bar and has an apartment in back where I will be living. I'm a little confused regarding insurance. Do I get commercial business insurance for the building, and then separate homeowners insurance for the small apartment in back? Though I feel that would be strange as it's one large building essentially. Just curious what others have done, it's too late to call now, yet I will in the morning.

Churchill Car Insurance Problem?

Had accident which was my fault in Nov 08, hit a van in rear that stopped suddenly going through a roundabout (less than 5mph) and his trailer hitch ball went into my radiator and damaged the hood, grill and radiator. Car was 1996 Honda in very reasonable condition, MOT'd and all in good service despite its 125,000 mileage, new tyres, exhaust, battery, and clean throughout. Had fully comprehensive insurance with 50 deductable, loaner car and legal support so paid to be protected. When car was collected from accident, collecting garage said at that time that due to the mileage my car would not be repaired. However it took 5 to 6 weeks for the insurance examiner to determine that my car was beyond repair, so I did without a car all that time. Despite repeated phone calls to them, they never called me back as their examiner was on holiday. Then when we finally agree that a price of 500 for my car in January 08 and that took some haggling, the cheque never and so I started chasing them down in early February. I am then informed that I did not disclose a speeding violation on my application and they would have to listen to the tapes of my applying to verify this. Again this took several weeks, and I again had to pursue them for an answer to which they then said I had applied on the internet so no record of a phone conversation. The internet application was misleading, asking for what I believed was 3 years worth of offenses. I've only ever had 2 speeding offenses in my entire life - both speed cameras, just over the limit. The first was at 6 a.m. and I passed a bus pulling over to stop and as I passed it got flashed. The second on the day I found my dad had days to live and I was rushing to catch a flight, and as in both instances was doing 42 mph in a 30 mph zone for a very short period. Nonetheless, I was speeding and paid my fines. I wrote to the insurance company and apologised for not telling them of the other speeding ticket from 4 years and 9 months earlier as I forgot about it. But I admitted it, and apologised in writing. Then then came back to me saying that there would be additional premium to pay before I would get paid for my car. Well, its October 08, and I finally got a letter from the insurers saying they are not paying me as I failed to pay the additional premium requested and they were not going to renew my policy. I have never been asked even after repeated letters to them how much the additional premium was, and what I should do. No replies. I have asked for my car back which they agreed to pay for, and now they state there is nothing they can do, and it is their final decision. I went to the financial ombudsman and unbelieveably DID NOT get a reply from them. I've even spoken to one of their survey staff who tells me that they are incredibly busy and it was probably put aside and not dealt with. I'm at a total loss as to where I stand and how to pursue this without spending more than the accident and car was worth. I've written to their data protection officer and obtained copies of all documentation pertaining to this, so by their records can verify all this information quite clearly. Finally, I maintained my cool with them at all times. Never once did I raise my voice or become unprofessional with them. My questions are: 1. Can I legally request my car back as it has never been paid for? 2. Were they taking money for policy on a car they knew that through mileage alone, they would never pay for loaner car, or to have repaired? 3. This has meant over 30 letters and more phone calls than that to deal with, and rarely do they call you back or reply at all. Can I claim for this time and distress? 4. Am I totally wasting my time? I received a non moving violation for exhaust/more. Will my insurance go up?

I received a ticket the other day for modified exhaust (Vehicle code 27151 Article B) and Gross polluter (Article 27156). Both are checked as non correctable, but I plan to go to the Ref because A. Gap insurance and warranty on car that was totaled?

I am not sure who is right on this one.... We bought a car in 12/11. We purchased gap insurance and an extended warranty at that time through the dealer. We decided to refinance the car through the credit union were we are members. The gap insurance was 1/2 the price we purchased at the dealer. The dealer and bank said that we should receive a refund. In the process of all of this the car was totaled by my 18 year old daughter in March. 1. We recieved a check made out to us from the dealer for the gap insurance.(pro-rated 4 months) 2. The dealer turned in the paperwork for us for the refund on the warranty and the warranty company sent it to the previous lein holder that we left. The initial bank in turn said it was our money and reissued a check made out to us. Any thoughts appreciated. Is it really our money?

Weather Related Car Accident How Much Will Insurance Pay For?

Ok so I was driving home late morning a few nights ago, it was snowing pretty badly making conditions pretty bad, difficult to drive in and especially with my car (eclipse) so I was not doing any more then I could handle. I was on the highway going around 15-25 mph at most. Suddenly I began to swerve and spun out and got turned around and finally hit the guardrail, not much force because I was driving pretty slow to begin with. So the side of my car hit and I ended up facing the other direction. I have noticed there are a few scratches and marks on the front side one on headlight, a little below the headlight and some orange marks along the side, also a crack on the very bottom of the back bumper (not sure how it got there, kinda in the middle) So I was the only one involved and was wondering since it is a weather related accident how much my insurance will pay for? im just very confused because I am not looking forward to body shop and getting estimates, Greatly Appreciated Thanks
